There are so many reasons for Americans to understand and practice nullification — nullifying federal intrusions into our lives and nullifying federal restrictions on our private personal and economic lives and livelihoods.
On his radio show last night Jason Lewis was discussing the annoying same-sex marriage issue, along with the even more annoying Don’t Ask, Don’t Tell issue. I have addressed that several times, including here and here. Lewis believes that there is “no right to marry,” whether one is homosexual or heterosexual. Well, he is very much mistaken. Of course one has a right to marry. You own your life, and you have a RIGHT to do with your life whatever you want, as long as you don’t interfere with anyone else’s equal right, and no one has a right to interfere with that, not the government, your neighbors, no one.
“But the right to marry is not enumerated in the Constitution,” some people say. Well, the Constitution has many, many, many many problems, including not possibly being able to enumerate every possible right that you have that deals with how you want to live your life, with what kind of contracts you want to voluntarily establish with others, what associations you want to have, etc. And the Founding Fathers recognized that weakness in the Constitution, at least the ones who weren’t retarded, and in their attempt to overcome that problem they came up with the Ninth Amendment.
The Ninth Amendment reads as follows:
The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.
And, more important is our Declaration of Independence. While not used as the basis for law as the Constitution is (unfortunately, and to our peril, although the Declaration does have great weight — but not to Elena Caveman, unfortunately), the Declaration recognizes that “all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.”And by “all men,” that refers to all of humankind. Duh.
And these are individual rights. The individual has a right of ownership of one’s own life, and has a right to one’s life, Liberty and the pursuit of happiness. The right to Liberty means that the individual has a right to be free from aggression of others, the right to be left alone by others, and the right to be free from anyone else intruding into one’s life and property. This includes the individual’s right to establish any private contract with any voluntary and mutually consenting others, and it’s no one else’s business. So, of course that includes the right to marry. Duh.
With the Declaration of Independence’s words, any positive legislative acts with police power that would be put in place that intrude into private individuals’ private lives — including their relationships, associations, marriages, etc. – violate those individuals’ rights to “life, Liberty and their pursuit of happiness” which is nobody else’s business but those individuals’. And with the Ninth Amendment to the U.S. Constitution, any such positive legislative acts with police power violate such individuals’ Ninth Amendment rights.
It will be necessary for Americans to nullify these social dictates that social fascists want to shove down the throats of the rest of us. I’ll discuss nullification more below.
On the issue of taxes, it appears that several of Nancy Smelgrosi’s minions in the House and Harry Reek’s flunkies in the Senate might attempt to block passage of the deal between the GOP and Democrats that would extend the Bush tax cuts, which are due to expire January 1st, the expiration of which would mean that all taxes will suddenly go up as of January 1st. I already discussed that in yesterday’s post.
That sudden tax increase — caused by Nancy Smelgrosi and Harry Reek — will steal even more from the workers and producers, many of whom have families to support and are already barely surviving from paycheck to paycheck. Such a tax increase will devastate many of them. But wealthy Nancy Smelgorsi doesn’t have to worry about those circumstances happening to her family, does she?
Worse, Fed Chairman Ben Burnbanker’s Quantitative Easing II will further distort the economy, and cause huge price inflation especially with food and energy prices that will further burden low- and middle-income families, and this on top of the food and energy prices that are already going way up since just September. As Ron Paul noted, it is “criminal” what they’re doing.
If the Bush tax cuts expire on January 1st for the “wealthier” Americans, that will include those families with an income of over $250,000, but with three or four kids to support and while putting them through college, etc., that combined with Ben Burnbanker’s intentional inflation will be a double hit on them. If the “millionaires and billionaires,” the ones who own the biggest companies, employ the highest number of workers per individual big company, and the ones who buy the most “big ticket” items that feeds the productivity of America’s manufacturing sector, suddenly get hit with higher taxes, as I mentioned yesterday, they will close plants, dramatically decrease their expansions and investment, and MORE layoffs will occur, which will further hit low- and middle-income families.
It really should be considered criminal what they are doing, this collusion between the Fed’s “mad scientist” and the ideological economic ignoramuses in Congress, especially if the taxes are allowed to suddenly increase on January 1st. Burnbanker’s intentional inflation might get out of control and cause hyperinflation. And all this during a severe recession/depression/whatever it is. Not only is this collusion among these politicians (and Ben Bernanke is not an economist — he’s a politician, no doubt about it) criminal, but they literally should be indicted. Why the hell do we even have a “Justice” Department anyway, if these criminals are allowed to get away with their crimes, after all?
I think that Washington is just out of control, in this so-called domestic policy, as well as their out of control foreign policy. They are literally crazy gangsters, trespassing into the American people’s private bank accounts, private businesses and private lives, and literally trespassing onto the foreign lands of foreign peoples, the actions of which have done nothing but provoke hostility from the inhabitants of those foreign lands.
Here is what needs to be done to save our Liberty, and save us from further becoming an impoverished, Third World dictatorship. Each state needs to secede from the “union,” at least informally through nullification. If people don’t understand the idea of nullification, and that we have a right to nullify the federal government, Thomas Woods details all that in his book, Nullification, as well in this article, and this article, and Thomas DiLorenzo discusses that here and here as well.
And yes, we have a RIGHT to nullify intrusions into our lives, it’s that simple. The Declaration of Independence notes,
That whenever any Form of Government becomes destructive…it is the Right of the People to alter or to abolish it…when a long train of abuses and usurpations, pursuing invariably the same Object evinces a design to reduce them under absolute Despotism, it is their right, it is their duty, to throw off such Government, and to provide new Guards for their future security.
The aforementioned Ninth Amendment, and the Tenth Amendment to the U.S. Constitution protects our God-given right of nullification. Those who are opposed to nullification are statists, and love the State, and love the State’s authoritarian control over the people, and oppose freedom.
Each state needs to nullify all federal property and wealth confiscations, all intrusions, all regulations, mandates, dictates, and commands that violate any individual’s right to life, liberty and property.
Each state needs to nullify federal legal tender laws and legalize gold and silver as a valid means of exchange, and allow for competing currencies, and each state needs to nullify federal banking laws, such as the National Bank Act and subsequent legislative dictates, and outlaw fractional reserve banking as the fraud that it is, and outlaw banking cartels that are protected by the government and that restrict the people’s right to do banking freely, under the Rule of Law.
Each state needs to nullify all federal energy and environmental laws and regulations, and drill for oil and gas in their respective states. The people of each state need to seize any federally-owned property in their state and sell it to the highest bidder. The inhabitants of territories have a God-given right to use or sell any natural resources that exist on the lands they inhabit. The states need to view the federal government in Washington as a foreign government, an intruder, invader and hostile to their liberty, for that is what the tyrants in Washington have become: foreign invaders against the American people.
And each state needs to nullify constitutional mandates that allow the U.S. federal government to monopolize territorial protection and that restrict the inhabitants of the U.S. states from their God-given right of self-defense. That is because monopolization and centralism of territorial protection does not work. Such a scheme has done nothing but encourage the parasites in Washington to deliberately provoke elements abroad and has made us less safe.
Everything Washington has done especially in the past century has gone against the American people. We are victims of the State, and of the 20th Century, and all its collectivism, statism, State-crimes, and tyranny. Even further than just nullification, we need to “repeal the 20th Century,” as Murray Rothbard noted,
Heaven forfend! Who would want to repeal the 20th century, the century of horror, the century of collectivism, the century of mass destruction and genocide, who would want to repeal that! Well, we propose to do just that.
With the inspiration of the death of the Soviet Union before us, we now know that it can be done. We shall break the clock of social democracy. We shall break the clock of the Great Society. We shall break the clock of the welfare state. We shall break the clock of the New Deal. We shall break the clock of Woodrow Wilson’s New Freedom and perpetual war. We shall repeal the 20th century.
One of the most inspiring and wonderful sights of our time was to see the peoples of the Soviet Union rising up…to tear down in their fury the statues of Lenin, to obliterate the Leninist legacy. We, too, shall tear down all the statues of Franklin D. Roosevelt, of Harry Truman, of Woodrow Wilson, melt them down and beat them into plowshares and pruning hooks, and usher in a 21st century of peace, freedom, and prosperity.

I think many people who are awake are coming to realize the the federal government is truly, as you say, out of control. There obviously is no way an individual or group can stand up to the federal government, unless they wish to die at the hands of black clad ninjas. The states, on the other hand, are sovereign and have the legitimate authority to interpose to protect their people, including to protect them from an out of control federal government. I think state interposition is the most likely way in which we will be able to protect our liberties.
